Captives, Congress and the NAIC
An update on the proposed amendment to the federal Liability Risk Retention Act (H.B. 4802) that would expand allowable coverage to property insurance and the NAIC's policy initiatives regarding captives and risk retention groups.

Health Insurance Through Captive Arrangements
Representatives from a D.C. domiciled captive insurance company will discuss their experiences and observations as a D.C. captive writing employee health insurance directly for the captive’s members which are education, research-related and public service associations domiciled in the District of Columbia. The presenters will discuss the structure of the captive, the inter-play of the various service providers and the benefits of the captive and wholly owned agency to its members in pricing and benefits structure.
The second portion of the session will focus on the use of single and multiple parent captives and segregated cells to provide excess of loss and premium loss stabilization to medical providers and pharmaceutical firms as they respond to the changes in the health care environment. The presenter will specifically discuss the use of captives:
- as an “accountable care organization” to accept and manage fixed payment risk from the health plans
- to segregate the cost of mandated coverage requirements
- to provide premium stabilization around Medicare Part D
- to provide secondary excess of loss insurance to reduce uncertainty around unlimited annual and lifetime benefits
- to prepare to replace the Federal reinsurance program for early retiree benefits.

Employee Benefits in Captives
The number of companies funding employee benefits in their captives continues to increase. Participants in this session will learn what is driving the increased interest in funding employee benefits in a captive through an analysis of the current market. This session will also include a concept overview of funding employee benefits in a captive, including examining benefits, the feasibility process, working with the DOL and how to move the process forward.

MMSEA Section 111: How Does This Affect Captives?
The Centers for Medicare and Medicaid Services mandated Section 111 of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) (P.L.110-173) adds new mandatory reporting requirements for group health plan (GHP)arrangements and for Liability Insurance (including Self-Insurance and captives), No-Fault Insurance, and Workers' Compensation. These are numerous and onerous. How does this affect captives? How can you protect your company, your clients? There are few rules yet and a rolling effective date.
